O objetivo deste artigo é demonstrar que no contexto da União Europeia, a liberdade da mídia é indissociável do conceito do pluralismo. Para isto, selecionamos documentos e casos do Tribunal Europeu dos Direitos Humanos que tratam, direta ou indiretamente, esta questão. Apesar de este conceito estar sempre em disputa, sua força normativa é indiscutível, tendo sido abordado tanto em normativas do bloco europeu quanto em decisões oriundas do Tribunal Europeu dos Direitos Humanos que tratam do âmbito normativo da liberdade da mídia. Conclui-se que, na União Europeia, democracia, liberdade e pluralismo da mídia são conceitos inseparáveis, pressupondo-se em constitutiva tensão.

A revista Novos Estudo Jurídicos (NEJ), Qualis A1 Direito, é um periódico científico quadrimestral, com publicações ininterruptas desde 1995, nos meses de Abril, Agosto e Dezembro. A NEJ é um dos periódicos científicos da Universidade do Vale do Itajaí (UNIVALI) e está vinculado ao Programa de Pós-Graduação Stricto Sensu em Ciência Jurídica da UNIVALI (conceito CAPES 6), cursos de Mestrado e Doutorado.
